Terms and Conditions for Participation in Art Fuel Studio’s Online Course

By enrolling in, accessing or participating in Art Fuel Studio’s The Color Cure online course (the “Course”), you (“Participant”) indicate your acceptance of this agreement (the “Agreement”).

COURSE ENROLLMENT AND ACCESS

Participants must provide accurate and up-to-date information during enrollment. All Course and related materials, including lessons and resources, are provided on a nonexclusive, nontransferable, limited license basis and shall be accessible only to registered participants and are non-transferable. Access to Course content is granted only for the duration specified at the time of purchase. Any breach of the terms of this Agreement shall be cause for termination of this license. Participant may not remove or modify any Course markings or any notice of Art Fuel Studio’s proprietary rights or make the Programs available in any manner to any third party. All rights not expressly granted in this Agreement are reserved by Art Fuel Studio. If Participant wants to use the Course for any purpose other than as expressly permitted under this Agreement, Participant must obtain from Art Fuel Studio a license under a separate agreement permitting such use. Art Fuel Studio reserves the right to refuse service to anyone for any reason at any time. Art Fuel Studio is not responsible if information made available in the Course or on this site is not accurate, complete or current. Any use of the Course, associated websites, text, code or visual content to “train” generative artificial intelligence (AI) technologies to generate text, code, images or imitate style is expressly prohibited.

PARTICIPATION
Participants must be at least 18 years old or have parental/guardian consent. Access to the Course requires an internet connection and compatible device. Participants are responsible for ensuring they meet these requirements. Art Fuel Studio shall provide technical support, phone support, or updates at its sole discretion.

MEDIA RELEASE

By submitting artwork, images, or other creative content ("Submissions") as part of the Course, participants grant Art Fuel Studio a non-exclusive, royalty-free, perpetual, worldwide license to use the Submissions for Course -related purposes, including but not limited to: marketing, promotional and educational materials (e.g., social media, newsletters, website, courses, retreats). Participant agrees that any submissions will not violate any right of any third-party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or contain libelous or otherwise unlawful or abusive material. Participants consent to the use of their names and likenesses in testimonials or promotional materials.

WORK PRODUCT OWNERSHIP
Any artwork created during the Course by Participant shall remain the intellectual property of the participant.

NO RISK GUARANTEE
Participants may request a full refund within 5 days of enrollment if they are dissatisfied with the Course.

INTELLECTUAL PROPERTY PROVISIONS
All Course materials, including but not limited to videos, exercises, guides, PDFs, and lesson plans, are the exclusive property of Art Fuel Studio. Participants may not reproduce, distribute, sell, exploit or publicly share Course materials without prior written consent.

ASSIGNMENT
Participants may not assign, share or transfer their enrollment in the Course to another individual without prior written approval from Art Fuel Studio.

Disclaimer of Warranties; Limitation of Liability

THE COURSE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. ART FUEL STUDIO FURTHER DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

IN NO EVENT WILL ART FUEL STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR DATA USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ART FUEL STUDIO’S ENTIRE LIABILITY FOR DAMAGES UNDER THIS AGREEMENT SHALL IN NO EVENT EXCEED FIVE HUNDRED DOLLARS (U.S. $500).

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our services and products are subject to change. We reserve the right at any time to modify or discontinue the Course or other services (or any part or content thereof) without notice at any time. Art Fuel Studio shall not be liable to Participant or to any third-party for any modification, price change, suspension or discontinuance of the Course. Art Fuel Studio reserves the right, at its sole discretion, to update, change or replace any part of these terms by posting updates and changes to our website.

THIRD-PARTY LINKS

Certain content, products and services available via the Course may include materials from third-parties. Third-party links may direct Participant to third-party websites that are not affiliated with Art Fuel Studio. Art Fuel Studio is not responsible for examining or evaluating the content or accuracy and it does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

INDEMNIFICATION
Participants agree to defend, indemnify and hold Art Fuel Studio, its owners and employees harmless from any losses, costs, claims, damages, or expenses arising out of their participation in the Course, including but not limited to breach of this Agreement or any third-party intellectual property disputes.

CHOICE OF LAW AND FORUM
These terms shall be governed by and construed under the laws of the State of California. Any disputes arising shall be resolved exclusively in the courts of Marin County, California.

SURVIVAL
Provisions regarding intellectual property, indemnification, and limitation of liability shall survive the termination or expiration of these terms.

STATUS OF PARTIES
Participants are customers and not employees, agents, or partners of Art Fuel Studio. Participation does not create any joint venture or agency relationship.

NOTICES
All notices and communication required under these terms must be sent in writing to Art Fuel Studio at [email protected].

ATTORNEYS’ FEES AND COSTS
This Agreement is subject to the laws of California and you agree that, in the event of any litigation between the parties, the jurisdiction will be the applicable court of Marin County, California, and nowhere else for the resolution of any dispute under these terms. However, should a dispute arise between the parties, the parties agree now that they will submit to final and binding arbitration before a single arbitrator, selected by Art Fuel Studios, in accordance with the American Arbitration Association Rules. Any judgment on an arbitrator’s award, if made, is final and binding and may be entered into any court having the appropriate jurisdiction. In the event of a dispute between us, you agree to not engage in any conduct or communications, public or private, including social media, designed to disparage Art Fuel Studios

SEVERABILITY
If any provision of these terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

BINDING EFFECT
These terms are binding upon and inure to the benefit of the parties and their respective heirs, legal representatives, successors, and permitted assigns.
